This week, former Special Counsel Jack Smith who led multiple federal criminal investigations into President Trump said he was willing to publicly testify on Capitol HIll.

In a letter to Congress, Smith’s attorney qualified the offer, stating certain conditions must be met.  Smith would require clearance from the Justice Department and legal guidance to avoid violating grand jury secrecy rules.   

Smith is taking the position that his investigations into President Trump’s “alleged mishandling of classified documents and role in attempting to overturn the results of the 2020 election” have been grossly mischaracterized by his GOP critics.  

This is a not so subtle reference to recently declassified records from FBI Director Kash Patel, that among other things, show an FBI probe codenamed ARCTIC FROST obtained phone records from nearly a dozen republican lawmakers.  

Smith’s offer to publicly testify may be a genuine effort to clear the air and provide needed transparency or a calculated political trap.

ARCTIC FROST formed the basis of Special Counsel Jack Smith’s electors case against President Trump.  The lingering question has been who green-lighted the investigation of the then former president.

The four page Justice Department memo dated April 4, 2022 shows the approval came from the very top of the Biden Administration.  The memo bears the personal signatures of then Attorney General Merrick Garland, his Deputy Attorney General LIsa Monaco and then FBI Director Christopher Wray.

The final page of the memo shows a handwritten note from Monaco to her boss Garland, “I recommend you approve.”

Public interest in the ARCTIC FROST records is understandably high.  While there have been several recent developments documented in this newsletter, the new records about who approved the criminal probe exploded online.  

Less than one day after GOP Senator Chuck Grassley posted the Justice Department memorandum on X, it drew over 2.5 million views.   (MY NOTE: Not many 92-year-olds have over a million followers. Impressive!)
