JAMES COMEY IN THE DOCK
Former FBI Director's Legal Jeopardy is Real
TOP LINE
While legacy media downplays Comey’s legal jeopardy, it is real, and growing by the day.
The North Carolina indictment filed against Comey for allegedly threatening President Trump with the “8647” seashell photo on Instagram is likely just the beginning.
To get “86’d” is widely interpreted as a threat of harm. President Trump is, of course, the 47th Commander in Chief.
My contacts report there could be additional charges in North Carolina, what’s known as a superseding indictment.
Any false or misleading statements by the former FBI Director to federal agents would be violations of 18 USC 1001.
My analysis is buttressed by the Acting Attorney General Todd Blanche’s Sunday interview with NBC’s Meet The Press.
"Rest assured that it's not just the Instagram post that leads somebody to get indicted,” Blanche said.
"The career FBI agents, the career Secret Service agents that investigated this case, didn't just look at the Instagram post and walk away.”
Comey may ULTIMATELY be tripped up by the same criminal statute he relied on to prosecute members of the Trump team during Russia Gate.

DEEP DIVE
Before we begin, and because many of you asked, here is a reminder of players in the “Grand Conspiracy.”
James Comey - Former FBI Director
Daniel Richman – Comey friend, personal attorney and Columbia Law School Professor
John Brennan - Former CIA Director
Chuck Grassley – Republican Senator, Chairman Senate Judiciary Committee
Kash Patel - FBI Director, former congressional investigator who uncovered Russia Gate
Bloomberg Law broke an important story this week.
Bloomberg reported that prosecutors in the Eastern District of Virginia are exploring new criminal charges against Comey for leaking documents, including classified information, to Daniel Richman.
If the charges move forward, it would be the third indictment of Comey by the Trump Justice Department. The first indictment for allegedly lying to Congress was dismissed on a technicality after the US Attorney’s appointment was deemed defective.
Regular readers of the newsletter are familiar with the Daniel Richman saga. We first reported that declassified records suggest Comey’s Columbia Law School professor buddy has his own legal exposure.
COMEY’S LEGAL POSITION GETS WORSE
With Comey virtually all investigative threads lead back to a May 2017 congressional hearing. On Capitol Hill, Comey’s difficult relationship with the facts was on full display.
