Did Fauci Partially Waive His Fifth Amendment Rights?

On Wednesday August 5th, the Senate Homeland Security and Governmental Affairs Committee is scheduled to vote on holding Dr. Anthony Fauci in contempt of Congress.  

If the contempt vote passes, the committee’s GOP Chairman Rand Paul has already promised to send a criminal referral to the Justice Department for prosecution.  

The move is not without precedent. Trump associates Peter Navarro and Steve Bannon were held in contempt of Congress and jailed as a consequence.

Taking the Fifth in a congressional hearing is not a legal strategy without risk. It has potentially opened the door to multiple legal actions against Dr. Fauci at the federal and state level.  

Dr. Anthony Fauci is 85 years old. He has served the U.S. government for five decades.  

While it is unclear whether any of these legal strategies will result in charges, let alone a conviction, it seems Fauci will spend his remaining years knee-deep in litigation, paying hefty legal fees, his reputation tarnished and diminished.  

The Fauci case is shaping up to be a good example of a well known inside-the-Beltway phrase: the process is the punishment.
